She finds the appointment of the special counsel was illegal.
District Judge Aileen Cannon ruled this week that the appointment and funding of Special Counsel Jack Smith in the classified documents case against former President Donald Trump was unlawful. She dismissed the case two days after an attempted assassination of the former president.
Judge Cannon wrote in her 93-page opinion, “Since November 2022, Special Counsel Smith has been exercising ‘power that [he] did not lawfully possess.’ All actions that flowed from his defective appointment — including his seeking of the Superseding Indictment on which this proceeding currently hinges — were unlawful exercises of executive power.”
Judge Cannon cited Justice Thomas in the Supreme Court opinion regarding presidential immunity. Justice Thomas wrote, “If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President.”
As the Lord Leads, Pray with Us…
- For Judge Cannon to be led by the Lord as she hears and rules on the cases before her court.
- For the special counsel and DOJ officials as they prepare an appeal to the dismissal.
- For discernment for former President Trump and his legal team as they address the remaining cases that have been brought against him.
